Hereinafter referred to as the “Seller”.

  1. Definitions

Customer – any natural or legal person who places an order on the site.

Consumer – a natural person acting for purposes outside their commercial or professional activity.

Website – online store available at www.nichita.ro⁠.

Order – request sent electronically by which the Customer expresses his intention to purchase products.

Distance contract – contract concluded between the Seller and the Customer, without the simultaneous physical presence of the parties.

  1. Placing the order

Orders are placed exclusively online, through the WooCommerce platform.

By placing an order, the Customer confirms that:

the data provided is real, correct and complete;

has read and accepted these Terms and Conditions;

understands the characteristics of the ordered product.

The Seller is not responsible for incorrect information provided by the Customer (wrong address, incomplete data, etc.).

  1. Order confirmation

After placing the order, the Customer receives an automatic email confirming the registration of the order.

This email is for informational purposes only and does not constitute acceptance of the order or conclusion of a contract.

The seller reserves the right to verify and validate the order before confirmation.

The products in the online store are labeled so that you receive information such as the size and the correct way of measuring, the color, the price and the materials from which they were produced.

While placing an order, choose the product by selecting the size, color, quantity and any other features as required.

All registered orders will be confirmed by phone, in order of receipt, between 09:00 and 17:00, on working days.

The production of a product takes an average of 3-5 days, depending on the complexity of the execution, and shipping is done by express courier, within approximately 3-7 working days from the date of telephone confirmation of the order.

Our products can be personalized by laser engraving on leather for a fee. Also, on some buckle models, CNC customization is available (made on the back of the buckle). Orders containing personalized products are paid in advance by card directly on the site.

  1. Conclusion of the contract

The distance selling contract is considered concluded exclusively at the moment of explicit confirmation of the order by the Seller.

Simply registering the order on the website does not obligate the Seller to deliver the products.

  1. Refusal to process orders

Atelier Nichita SRL reserves the express and discretionary right to refuse, cancel or limit the processing of orders before confirmation, in justified situations, including, but not limited to:

incorrect or incomplete information provided by the Client;

inability to process the payment;

reasonable suspicions of fraud;

abusive or repeated use of return or warranty policies;

speculative or unfounded requests;

repeated placement of canceled orders for reasons attributable to the Customer;

aggressive, abusive or inappropriate behavior in communication;

any situation that may generate material or reputational damage.

If an order is canceled before confirmation, and payment was made in advance, the amount will be refunded in full via the payment method used.

The exercise of this right represents a legitimate measure of trade protection and does not constitute a discriminatory practice.

  1. Pricing and Payments

The prices displayed on the site are expressed in lei (RON) and include VAT.

The seller reserves the right to change prices without prior notice, the changes not affecting already confirmed orders.

The available payment methods are those displayed on the site at the time of placing the order.

  1. Delivery of products

Products are delivered by courier, both within Romania and internationally.

Delivery times are approximate and may vary depending on:

product availability;

delivery destination;

the courier’s logistical conditions.

The risk on the products is transferred to the Customer at the time of delivery to him.

For international deliveries, the Customer is responsible for any customs duties or additional taxes applicable in the destination country.

  1. Right of withdrawal (Return – 14 days)

The consumer has the right to withdraw from the contract within 14 calendar days of receiving the product, without giving a reason.

To exercise the right of withdrawal, the Customer must send the request to the following address: shop@nichita.ro.

The product must be returned:

in proper condition;

without excessive traces of use;

with all accessories and related documents.

The customer is responsible for any diminution in the value of the product resulting from manipulations other than those necessary to determine its nature and characteristics.

Excessively worn, damaged or affected products may be subject to a proportional reduction in the amount refunded.

  1. Legal guarantee of conformity

The products benefit from the legal guarantee of conformity according to applicable legislation.

The warranty exclusively covers manufacturing defects or non-conformities existing at the time of delivery.

For genuine leather products (including belts):

The following are not considered defects and are not covered by the warranty:

normal wear and tear resulting from use;

scratches, natural patina or discoloration;

lengthening of holes through wear;

deformations caused by tension;

blunting of edges;

damage caused by improper maintenance.

Genuine leather is a material that evolves over time. Aesthetic changes are normal characteristics, not non-conformities.

Warranty claims are subject to internal technical review.

  1. Limitation of liability

The seller cannot be responsible for:

improper use of products;

damage caused by external factors;

delays attributable to courier companies;

indirect losses resulting from the use of products.

  1. Dispute resolution

Any disputes will be resolved amicably.

If an amicable settlement is not possible, jurisdiction lies with the courts of Constanta, Romania.
